Foreign Trademark Registration How many ways?
Trademark registration in Thailand does not apply to foreign countries. Since trademark law is based on the principle of “register in which country, protect that country”, if you export goods or services to foreign countries. You also need to apply for a trademark overseas. To prevent trademark infringement or prevent other entrepreneurs from registering their trademarks abroad without being the actual owners.
Now let’s see how to register trademarks abroad. How can this be done?
1. Submit via Madrid Protocol
The Madrid Protocol is a system that facilitates trademark owners to obtain trademark protection abroad (member countries only) without the need for the applicant to prepare an application for submission in each country directly. The application can be submitted at the originating office (for Thailand through the Department of Intellectual Property) to the World Intellectual Property Organization (WIPO), and then WIPO acts as an intermediary to distribute the request to the intellectual property offices of countries that are members of the Madrid system.
To register with the Madrid system, the applicant must have submitted an application for trademark registration in Thailand using the application number or registration as an international reference.
The Madrid system facilitates trademark registration applicants to submit applications for registration abroad. Both in terms of costs and fees that are more economical than filing directly with the intellectual property office of that country, as well as the applicant does not have to prepare a trademark registration application for registration in each country. It also does not need to set up a trademark representative in that country by submitting a trademark registration application through the Madrid system to obtain protection in different countries, relying on one application and can apply for protection in 91 countries around the world such as the United States, European Union, United Kingdom, France, Germany, Russia, China, Japan, Korea, Australia, New Zealand, India or ASEAN countries such as Singapore, Vietnam, Philippines, etc.
2. Submit directly to the intellectual property office of that country.
In the case of the destination country in which you wish to obtain trademark protection. Not a member of the Madrid Protocol or have never registered a trademark in Thailand. You need to apply for registration directly in that country, and you need to appoint an agent in that country. To process the trademark registration for you.
